Rx Depot asks court
to stay Canadian drug
shutdown order


TULSA, Okla. >> A Tulsa-based company that helps its customers buy cheaper prescription drugs from Canada asked a federal appeals court yesterday to block a Nov. 6 judge's order shutting down its 85 storefronts.

Rx Depot asked the 10th U.S. Circuit Court of Appeals in Denver to allow the company to reopen its locations in 25 states until the court decides whether its business practices are legal.

The case is being monitored in many states, including Hawaii, where there are other such programs. Canada Discount HealthCare Services of Hawaii and Canada Discount RX of Winnipeg are the two drug discount programs operating in Hawaii.

In the Oklahoma case, the Justice Department has asked Judge Claire Eagan to shut down Rx Depot at the request of the Food and Drug Administration. The FDA argued that the safety of drugs from Canada could not be ensured.
