Couple sues Maui County
over flooding

WAILUKU >> A couple who rented a home in Lahaina has filed a lawsuit against Maui County, charging it was negligent in failing to take measures to improve drainage in an area prone to flooding.

Also named as defendants in the lawsuit filed Tuesday were the house's owner, Charles Barker, and the real estate management business Prudential Maui Realtors Inc.

Troy and Rebecca Richardson allege Barker and the management business were negligent in warning them that their rental unit was prone to flooding.

The Richardsons' rented house at 570 Wainee St. was flooded in late January 2002, following a storm that dropped about 5 inches of rain in Lahaina.

The Richardsons, who had been married only five weeks before the flood, did not list the amount of money they were seeking in the lawsuit.

At the time of the flooding last year, Troy Richardson initially estimated the loss of personal belongings at $40,000.

Maui County settled a lawsuit in 2001 for an undisclosed amount of money with several Lahaina residents along Wainee Street for flooding in 1997.
