The state Department of Health's Clean Air Branch issued notices of violation and orders to three separate companies and a Kauai resident for air pollution violations.

The Clean Air Branch cited Puna Rock Co., Edwin DeLuz Trucking and Gravel LLC, Carbon Diversion Inc. and Kauai resident Thomas Taylor last year.

Taylor, of Kilauea, burned green waste in the open on April 8, 2008, without having an agricultural burning permit from the Health Department. The violation was discovered after a complaint was made. A $3,100 penalty was imposed for the violation.

On Oahu, Carbon Diversion violated a permit for test burn conditions at Campbell Industrial Park by burning shredded tires, failing to conduct a source performance test and conducting a test burn without prior notification to the Health Department. The violations were discovered on July 2, 2008, during an inspection. A $1,600 penalty was imposed.

On the Big Island, Edwin DeLuz Trucking and Gravel was also cited for its crushing plant in Hamakua. Some of its violations included failure to maintain a water pressure gauge at the water supply tank and take precautions to control dust throughout the facility. The violations were discovered on Aug. 27, 2008, during an annual inspection. State health officials imposed a $6,300 penalty. Negotiations are currently under way to resolve the matter.

Officials said Puna Rock failed to submit its semi-annual monitoring reports for a six-month period in 2008 for the crushing plant in Keaau. The violation was discovered on Sept. 19, 2008, during a review of records. A $2,600 fine has been paid for the violation.
