Girl interrupts assault with tale of friend nearby

A 13-year-old girl told a man who forced her into his car and attacked her sexually that she had a friend who lived nearby, which apparently made the man stop his advances, according to court documents.

A preliminary hearing is set for tomorrow for 44-year-old Asoailoa Lealai, who is charged with kidnapping the girl as she walked to school Thursday.

A police affidavit said the man pulled up alongside the girl at about 7:25 a.m. and offered her a ride to school. When the girl refused, Lealai got out of his Ford Explorer, approached her from behind, grabbed her right arm and forced her into the car, the affidavit said.

He told her he would drive her to school but instead drove to 94-125 Pahu St. in Waipahu and began to touch her, the document said. That was when the girl said her friend lived nearby.

The man stopped and drove her to another spot, stopped and asked her for a kiss. When she refused he forcibly kissed her, the document said. That was when she escaped.

The girl went to school and reported the incident. Lealai, also known as Faisiota Lupe and Faisiuta Lupe, was arrested a short time later in Waipahu.

He made an initial appearance in court yesterday and was being held in lieu of $75,000 bail.

In 2001, Lealai was convicted of abusing a family member.

Man charged with murder in death of wife's suitor

A 44-year-old Maili man accused of beating his wife's boyfriend to death with a 2-foot metal rod last week appeared in Honolulu District Court yesterday.

Paul Kaeo was charged with second-degree murder in the death of Charles Kahumoku, whom he allegedly attacked Friday night after the victim drove up to Kaeo's Hakeakea Street home to pick up Kaeo's wife, Debbie.

Kaeo, on several occasions, told his brother-in-law that if he saw his wife with her boyfriend, he would kill the man, according to a police affidavit.

Debbie Kaeo was separated from her husband but was visiting him and her brother for dinner.

A preliminary hearing is scheduled for tomorrow in Honolulu District Court.

Kaeo has four sexual assault convictions and an abuse conviction dating to 2002.

Bail revoked for suspect in shooting of attorney

The man charged with gunning down and killing attorney Craig Kimsel will not be allowed to post bail pending his trial.

Circuit Judge Derrick Chan revoked Daniel Kahanaoi's $1 million bail after Kahanaoi pleaded not guilty yesterday to second-degree murder, first-degree burglary, committing the crimes with a firearm and violating a restraining order.

Police said Kahanaoi went to Kimsel's Oneawa Street home April 28 looking for his ex-girlfriend and shot Kimsel in the back after Kimsel told Kahanaoi his ex-girlfriend was not there.

Man guilty of sex with girl gets 1-year term in prison

A man who admitted having sex with a 15-year-old girl he met online through the girl's MySpace account will spend a year in jail.

A state judge handed down the prison term as part of Matthew Cargill's five years' probation yesterday for first-degree electronic enticement of a minor, two counts of second-degree sexual assault and five counts of third-degree sexual assault.

The mandatory sentence for first-degree electronic enticement is 10 years in prison. However, when Cargill, 32, committed the crime, the law allowed for sentences of probation. State lawmakers have since removed that option.

In addition, Cargill paid the state $9,000 rather than forfeit to the state the pickup truck in which he had sex with the girl outside her home on March 6, 2006.
