The Navy won't be fined for the release of 7,000 gallons of waste water from the cruiser USS Port Royal, which was stuck for nearly four days last month on a reef half mile south of the Honolulu Airport.

Laurence Lau, deputy health director for environmental health administration, said under the federal Clean Water Act the state Health Department has “;no jurisdiction over a Navy warship.”;

The Navy said the waste water was mostly seawater that was used to flush waste and had to be dumped before it backed up and endangered the crew.

State health officials will continue to monitor the investigation now being conducted by the state Department of Land and Natural Resources, Lau said. State land board officials have already said that it plans to seek monetary compensation from the Navy to cover the cost of the cleanup and restoration of the reef.
