WAILUKU » The owner of a dog that mauled a Maui woman was sentenced to 20 days in jail and fined $500 for failing to appear in court for arraignment and negligently allowing his dog to attack a person.
Scot Barrie pleaded no contest yesterday to the contempt of court and other charge.
Part-time District Judge Jan Apo set June 3 for Barrie to begin serving his 20 days in jail.
Apo also scheduled a restitution hearing for the victim, Sandra Sardinha, for Aug. 25. Sardinha has filed a lawsuit against Barrie.
Maui Humane Society official Aimee Anderson said she was pleased with the sentence.
"I think Apo recognized the seriousness of this type of crime and sentenced accordingly," said Anderson, the society's director of animal control.
Barrie also was fined $150 plus $20 in court costs on March 17 for noncompliance with the dangerous-dog law.
The dog, named Faust, was euthanized through lethal injection on April 6 at the Maui Humane Society's animal shelter. Barrie had failed to comply with the county Animal Control Board's order under the dangerous-dog law that outside windows be shut if the animal was kept in a house.
The 90-pound dog, about 5 years old, attacked Sardinha, a Haliimaile resident who was visiting a family at a Pukalani residence where Barrie lived on Nov. 16.
Sardinha had skin from her right ear grafted to her scalp to help cover a head wound, and she suffered numerous bites to other areas, including her neck, chest, left forearm and right jaw.
In a Dec. 1 decision, the county Animal Control Board gave Faust a reprieve but ordered Barrie to confine Faust in a kennel or a house with the doors and windows closed. But on Dec. 3, an animal control worker seized Faust after finding an open window at Barrie's residence.
