Death of son prompts

The parents of a 17-year-old Waialua boy who was among five people killed in a one-car crash after the intoxicated driver lost control while allegedly racing on a North Shore highway have sued the estate of the driver and others who might be liable.
On March 18, 2003, Jose Robin Delizo Jr. was riding in a Honda driven by Shannon Waiwaiole, 22, also of Waialua, when Waiwaiole tried to overtake a car that had passed them earlier, witnesses said.
The Honda veered off Kamehameha Highway near Kawailoa and slammed into a palm tree.
Besides Delizo and Waiwaiole, also killed were brothers Patrick, 21, and Kaimana Askew-Jackson, 13, and Rex Dicion, 37. None were wearing seat belts.
The Honda they were riding in was among three carloads of friends returning home from a celebration at Shark's Cove in Pupukea. Those in the other two cars apparently witnessed the crash.
Autopsy reports indicate Waiwaiole had nearly twice the legal limit of alcohol in his system at the time of the crash. Police said the car was traveling in excess of 80 mph on the two-lane road.
Donna Delizo and Jose Delizo Sr. are seeking damages to be determined at trial.
