June trial set for auto
theft and threat case

Richard Simms pleaded no contest yesterday in Circuit Court to six charges, including second-degree terroristic threatening and auto theft that stemmed from an altercation in Mililani last month.

His attorney, Rustam Barbee, entered the plea on behalf of Simms, 25, the son of Circuit Judge Sandra Simms. Trial was set for the week of June 1.

Simms was indicted March 17 with second-degree terroristic threatening, third-degree assault, car theft, driving without a license, driving while intoxicated and fleeing the scene of an accident on Feb. 2.

Simms allegedly attacked a 17-year-old boy without provocation, used racial slurs, then stole the car of a man who had stopped to intervene.

The car was found abandoned after Simms allegedly crashed it into another car in Waipio Valley.

Barbee said Simms "has faith in the Hawaii court system" and will let the judicial system decide the matter.
