Judge affirms guilt of man
who shot HPD officer

A judge has reinstated the attempted murder conviction against a man who shot a police officer at Makapuu in 1998.
Circuit Judge Marie Milks yesterday found that Peter Moses' defense attorney furnished to prosecutors his medical records and that Moses voluntarily disclosed the reports, waiving his physician-patient privilege.
The Hawaii Supreme Court last year reversed Moses' conviction, but ordered the lower court to hold an evidentiary hearing to determine whether Moses' toxicology reports were indeed produced by his attorney to prosecutors and whether he voluntarily disclosed those reports.
Moses was convicted of eight counts, including attempted first-degree murder for shooting officer Earl Haskell and attempting to shoot another officer after Moses was seen breaking into a car. He is serving a life term without parole.
