Pot advocate seeks probation clarification

HILO >> Big Island marijuana advocate Jonathan Adler has served his sentence. Now he wants to go back to using his medicine, which is marijuana.

On Friday, Adler, 50, completed six months in the Hawaii Community Correctional Center, the sentence he was given after pleading guilty to five marijuana felonies.

Nine hours after he was released, jailers told him to return, saying he owed four more days. Adler disagreed, but returned.

Finally free yesterday, Adler was in court asking Judge Greg Nakamura to clarify two conditions of the five years of probation he faces.

One condition says Adler cannot possess marijuana "while in custody." Adler says he is no longer in custody, and his medical marijuana registration allows him to possess marijuana.

Another condition prohibits Adler from being present where marijuana is used. That would prevent Adler, a pastor in the Religion of Jesus Church, from practicing his religion with other believers, who are mandated by their church to use marijuana.

Nakamura postponed a hearing until April or later, when expert witnesses can be called.

Boy arrested in fire at Aliamanu school

Police arrested a 13-year-old Salt Lake boy yesterday in connection with a fire at Aliamanu Middle School in November. The boy was arrested under suspicion of two counts of criminal property damage.

The Nov. 23 fire caused an estimated $90,000 damage to a portable classroom. It was a converted restroom which had been renovated for use by special needs students.

A Honolulu Fire Department investigator determined the fire was deliberately set. Firefighters also found evidence of attempts to start two other fires at the school.

Police with the help of school administrators said they identified two juvenile suspects. They were expected to interview and arrest the second suspect today. Aliamanu Middle principal Patricia Park said she did not believe the teenager arrested yesterday was a student at her school.

Ewa man arrested in '01 Waipio shooting

Police arrested a 25-year-old Ewa Beach man yesterday in connection with a Nov. 14, 2001 shooting near Waipio Neighborhood Park. No one was injured in the shooting. The suspect was arrested for investigation of one count of first-degree attempted murder, two counts of attempted second-degree murder, two firearm violations and an outstanding warrant.

The shooting involved two groups of men who were in a fight the previous day, police said. Another suspect was identified and arrested. However, police said, last month new witnesses identified the Ewa Beach man as the gunman.
