Molokai hui files lawsuit
challenging cruise ships

WAILUKU >> A Molokai group is challenging state agencies' approval of the first cruise ship visits to the Friendly Isle starting Dec. 28.

Hui Hoopakele Aina filed a lawsuit in Maui Circuit Court yesterday, naming as defendants officials of the state departments of Transportation and Land and Natural Resources.

"Bringing the cruise ship industry to Molokai will affect the island environment and community on every level ... " said Isaac Moriwake, an Earthjustice attorney representing the hui.

Hui spokesman Walter Ritte Jr. said the group wanted to know "the kind of substances" brought in by the cruise ship that could affect near shore fishing and Kaunakakai town's facilities, including restrooms.

"No one has given us any answers or even an opportunity to ask questions," Ritte said.

The Holland American Line and Princess Cruises are planning at least eight visits to Molokai through 2004, Earthjustice said.

The hui alleges two state agencies that oversee the use of coastal waters and land have failed to comply with environmental requirements and assess the impact of cruise lines on Molokai.

Sonia Faust, supervising deputy attorney general for land and transportation, declined to comment on the lawsuit, pending her division's review of the allegations.
