Marks, 39, is charged with the murder of 38-year-old Yoko Sanders, whose body was found Saturday in a Waikiki apartment. Her head and both of her arms had been cut off and laid next to her body. Her head was in a plastic bag.
Deputy Prosecutor Susan Won argued that Marks is a danger to the community because of the gruesome nature of the crime and because he raped a 13-year-old girl in 1991 while on probation for theft and credit card fraud. He was convicted of the rape in 1994.
Won also argued that Marks is a flight risk because when he was out on bail in the 1991 rape case, he left the state and was taken into federal custody for a separate criminal case in California.
Sanders' body was found in a fifth-floor apartment police described as a "trick pad" at 2509 Ala Wai. Marks lived in the apartment two doors away. Sanders' boyfriend found her body after she failed to return to her Moiliili residence. A friend told police Sanders had arranged a date Friday with someone who had a room at 2509 Ala Wai.
Videotape recorded by surveillance cameras showed Marks entering the building and exiting the elevator on the fifth floor with Sanders, police said. The resident manager said Marks was the last person to leave the apartment in which Sanders' body was found. The tape also showed Marks disposing of a trash bag containing Sanders' handbag in the garage of the building.
Marks was sentenced to 10 years in prison for the rape. He was released on parole in September 1998 but was taken back into custody the following January after testing positive for cocaine use. He served out the rest of his term and was released from Halawa Correctional Facility on May 15.
