Ezra chosen to serve on U.S. judicial body

Chief U.S. District Judge David A. Ezra has been chosen to represent the 9th U.S. Circuit on the Judicial Conference of the United States, the top policy-making body for the nation's federal courts.

Ezra was chosen by a vote of all the 9th Circuit Article III judges during the 9th Circuit Judicial Conference held July 15-18 in San Diego.

Each of the nation's 13 judicial circuits is represented by its chief circuit judge and a representative of its district judges. Ezra joins Chief Circuit Judge Mary M. Schroeder on the conference that advises the chief justice of the U.S. Supreme Court on policy for the federal courts.

"I am deeply honored and very excited about this opportunity," said Ezra, the first Hawaii judge to serve on the conference. He noted that serving on the Judicial Conference is equivalent to serving in the U.S. Senate.

His three-year term begins Oct. 1. He succeeds District Judge Judith Keep of the Southern District of California. As a conference representative, Ezra will also sit on the Judicial Council of the 9th Circuit.

City sued over beach concession dispute

A company that submitted the highest bid to run one of four beach service concession stands in Waikiki only to be disqualified a month later has filed suit against the city.

Waikiki Windriders and Hawaiian Ocean's Waikiki Inc., a joint venture, contends in its suit filed Wednesday that the city rejected its bid after the losing bidders protested, alleging fraud and collusion in the bidding process.

The plaintiffs contend the current operator of Stand No. 3 is about $250,000 in arrears with the city, did not submit a bid yet is still operating the stand.

Carol Costa, city spokeswoman, said because of an earlier protest, none of the contracts were awarded and the bidding process has ground to a halt. City lawyers are reviewing the challenges and had not yet seen the complaint filed by Waikiki Windriders. In the meantime the old concessionaires are still operating on a month-to-month basis, she said.

Waikiki Windriders and Hawaiian Ocean's had submitted the highest bid, more than $8,000 higher than the second-highest bidder. On May 24 the city accepted their bid and a deposit. On June 19, however, the city notified them by letter that all of their bids had been rejected, the suit said.

They sought an administrative hearing as provided by law and were denied. They appealed to the state Department of Commerce & Consumer Affairs, but a hearings officer ruled he had no jurisdiction to conduct an administrative hearing.

Waikiki Windriders and Hawaiian Ocean's are asking the court for a preliminary injunction to block the city from awarding the contract to Stand No. 3 until a full hearing is held. They also ask that they be awarded the contract as the highest bidder.
