lfujimori@starbulletin.comJason Perry has been held in lieu of $5 million bail for the murders, and $1 million cash-only bail for drug and weapons offenses in a separate case.
Deputy Prosecutor Chris Van Marter told Judge Dan Kochi that Perry poses a danger to the community and that the nature of the charges would make him a flight risk since he faces life without parole.
He is charged with two counts of second-degree murder and criminal conspiracy.
Van Marter had stated in earlier court proceedings that Perry poses a particular threat to those who have been cooperating with the prosecutor's office.
Perry was indicted in the strangulation of Tracey Tominaga, a 37-year-old Kapahulu woman whose body was found in a shallow grave near Makakilo on April 2, 3 1/2 months after she was reported missing.
The prosecutor alleged Perry wanted to kill her after she rejected his sexual advances, that he conspired with friends to deceive her and take her to a remote area where they beat and kicked her before he strangled her.
Perry allegedly shot 40-year-old Edward Fuller on Jan. 26 on Jack Lane in Nuuanu to silence him after he learned of Tominaga's murder.
Perry's attorney David Bettencourt argued that Van Marter's request is moot since Perry has no ability to post a $6 million bail.
Bettencourt told the court that if Perry continues to be held in custody, they would be hindered in preparing for trial, saying they need to review 50 taped witness statements and more than 2,000 pages of documents. Bettencourt asked that his client be allowed to have access to recording devices to listen to the tapes and police reports.
The judge told Bettencourt to take up the matter of trial preparation with the trial judge.
Seven others are charged with crimes ranging from assault to criminal conspiracy in connection with Tominaga's death. Ryan Onuma, Andrey Lake and Jamison Mitchell remain in custody.
Delaneo Puha, Vaughn Kaaumoana and David Magalei were released after posting bail. Marvin Cadiz is free on supervised release.
Trial is scheduled for the week of July 1.
