Man indicted in
2 related slayings

Bail set at $5 million for Perry as
7 others also are indicted
for alleged conspiracy

An Oahu grand jury indicted 23-year-old Jason K. Perry yesterday in the killings of two people earlier this year.

State judge Gail Nakatani confirmed bail for Perry at $5 million for two counts of second-degree murder and one count of criminal conspiracy.

Deputy Prosecutor Chris Van Marter told Nakatani that Perry conspired with others to kidnap, beat and kill 37-year-old Tracey Tominaga and, five days later, to silence 40-year-old Edward Fuller.

Van Marter said the motive for Tominaga's murder was personal.

She had been missing since Jan. 20. Police found her body April 2 in a shallow grave above Makakilo following an anonymous tip. Fuller was shot multiple times along Jack Lane on Jan. 26 and died the next day.

The grand jury also indicted Ryan H. Onuma, Delaneo K. Puha, 24, Andrey E. Lake, 23, Jamison Mitchell, 23, Marvin T. Cadiz, 23, Vaughn N. Kaaumoana, 35, and David V.C. Magalei, 23, for their alleged roles in Tominaga's death.

According to the indictment, Perry and Onuma agreed to deceive Tominaga and take her to a location where they, along with Puha, Lake and Mitchell, allegedly restrained her, threatened her with bodily injury, handcuffed and taped her.

The five then allegedly punched, slapped, kicked and struck her with a blunt instrument. They were indicted for criminal conspiracy.

Van Marter said several people who have described both slayings in detail are cooperating with police and prosecutors and that Perry is especially dangerous to them.

When police arrested Perry on April 5 in connection with Tominaga's death, they reported finding a loaded semiautomatic weapon, large sums of cash and crystal methamphetamine in his vehicle. Police charged him with gun and drug violations.

The grand jury indicted Onuma, Puha, Lake, Mitchell, Cadiz, Kaaumoana and Magalei for hindering prosecution.

The grand jury also:

>> Indicted Lake for second-degree assault for allegedly hitting Tominaga over the head with a large branch.

>> Indicted Onuma for first-degree attempted assault for allegedly seriously injuring Tominaga.

>> Indicted Puha, Mitchell and Cadiz for second-degree attempted assault for allegedly harming Tominaga.

All of the defendants except for Onuma and Magalei were arrested April 5 in connection with Tominaga's death. Only Perry was kept in custody. The rest were released pending further investigation. A 48-year-old Pauoa man also was arrested on April 5 but was not indicted.

Lake, Kaaumoana and Puha turned themselves in at the Honolulu Police Department main station yesterday. Magalei was arrested in Enchanted Lake.

Van Marter told the judge that Puha was also Perry's major supplier of crystal methamphetamine.

Mitchell, who is from Texas, cut Tominaga with a knife, Van Marter said. Kaaumoana allegedly disposed of a tarp and her belongings, and Magalei allegedly helped dig up the body and pour acid over it.

Attorney David Bettencourt, hired by Perry's family to defend him against the gun and drug charges, said he probably will represent him in the murder case.

Prosecutors "cut deals with these guys (named in the indictment) in order to implicate my client," he said. "I'm curious to see who's been given polygraphs."

Perry pleaded not guilty to gun and drug charges on Monday.
