2 appeal project
to reroute road

HILO >> Two Big Island men have filed a court appeal against a Board of Land and Natural Resources decision permitting reconstruction of Saddle Road across the island.

In the appeal, Dr. Daniel Morimoto and attorney Katsuya Yamada say the Land Board made six errors in approving a conservation district permit which would allow rerouting of the road.

The $163 million project has been pending for several years. The appeal affects only part of the federally funded first phase, which would realign the road around the Army's Pohakuloa Training Area.

Yamada participated in a court-like hearing on the conservation application. He said hearing officer Benjamin Matsubara was required to comment on each of Yamada's written proposals for a decision.

The appeal says Matsubara and the Land Board erred by refusing to comment on some points because the proposals weren't numbered.
