Release of state hospital
inmate deemed risky

A man acquitted by reason of insanity in 1973 for the fatal stabbing two years earlier of a 17-year-old boy is asking to be released from the Hawaii State Hospital.

Rogelio Sibolboro, then 23, was accused of stabbing Macario Badua as he watched a movie at the Zamboanga Theater in Palama, allegedly over an argument they had earlier.

But the state is opposing the request, saying Sibolboro has acted inappropriately after being released in the past.

While he has done well at the state facility where his medication is monitored, Sibolboro has wound up in trouble when he has been released over the state's objections, said Deputy Prosector Rom Trader.

He failed to take his medication when released to a care home and ended up taking a day trip. In another instance, a few days after his release, he was found running naked along the Kapalama Canal.

He has applied for conditional release at least three times, withdrawn a request at least once and been revoked once.

The state's main concern is the public's safety. "He's killed somebody and if he's not on medication and chooses to drink, it exacerbates his condition so the potential for becoming dangerous is there," Trader said.

Deputy public defender Darcia Forester asked for release based on a request by the State Hospital. A hearing is set for May 17.
