to the theft chargesA police lieutenant accused of receiving overtime pay he wasn't entitled to and attempting to file for additional overtime pleaded not guilty to the charges today but asked for a later court date to change his plea.
Timothy Mimaki, 41, a 19-year veteran of the Honolulu Police Department assigned to the Waianae/Kapolei district, pleaded not guilty to second-degree theft and attempted second-degree theft charges.
During his arraignment this morning, he also waived indictment and asked for a hearing to change his plea, which will either be guilty or no contest.
Mimaki's attorney Darwin Ching declined comment on the change.
Circuit Judge Richard Perkins scheduled a hearing April 11 for the change of plea.
According to court documents, the theft, valued in excess of $300, allegedly occurred in March 1999. The attempted theft charge arises from him allegedly filing for nonexistent overtime work in March and April 1999.
Mimaki was stripped of his gun and police powers and placed on desk duty. His case is being review by HPD's Internal Affairs division.
