2. Fortunato Barques III

An officer saw suspicious activity in an area of Pupukea plagued by car break-ins. After seeing Barques, 37, walking between parked cars and getting into his vehicle, the officer followed and parked his car across the road and ordered Barques and a woman out of their vehicle.

1. The woman got out and, following the officer's orders, lay face down on the ground.

2. Barques stepped out of the passenger-side door, crossed the road and leaped over a 4-foot-high wire fence.

3. The officer, walking on the road parallel to Barques, followed him to a private dirt road leading to farmland leased by Barques, and repeatedly ordered him to stop.

4. As Barques headed up the dirt road, a gust of wind blew open his shirt, and the officer, now about 10 feet behind Barques, spotted a shoulder holster. Barques stopped and made "a reaching motion toward his chest." The officer fired twice, hitting Barques in the back. Police recovered a .40-caliber Glock handgun at the scene. Barques died 61 days later.


Aftermath

The case is being reviewed by prosecutors.
