The Bishop Estate trustee
refuses to comply with
a May subpoena

The attorney general's office wants a state judge to order Bishop Estate trustee Henry Peters to hand over his state and federal tax returns since 1993, as well as information about the renovation of his Waianae home.

Yesterday, state attorneys filed court papers asking Circuit Judge Kevin Chang for Peters' personal income tax records and construction documents, which it had subpoenaed in May as part of its investigation into charges of financial wrongdoing by Bishop Estate trustees.

A state investigator said Peters' attorney Renee Yuen told him Tuesday that Peters would not authorize her to produce the records. The records were due June 2, but that deadline was extended several times, the state said.

Yuen said she plans to seek a protective order against the state's request. She said the documents requested by the state involve personal tax information and have nothing to do with the state's investigation of the estate.

Yuen added that the records also involve information filed by Peters' wife, who is not a subject of the investigation.

A hearing is scheduled for July 22.

Yesterday's motions come as the state has subpoenaed a local construction company, Rhino Roofing and Repairs Inc., about work done at Kamehameha Schools and at properties owned by Bishop Estate trustees. The state also has subpoenaed Peters' tax accountant, Wendell Yim, about Peters' home renovation; Yim is opposing the subpoena.
