A date for a new hearing
will be set on Monday

A petition to remove Bishop Estate trustee Lokelani Lindsey will be heard in Circuit Court and not Probate Court, effectively pushing back the date of a hearing that was originally scheduled for Feb. 27.

Probate Judge Colleen Hirai yesterday transferred trustees Gerard Jervis and Oswald Stender's petition for Lindsey's removal from the probate calendar to the civil calendar.

A date for the new hearing will be set on Monday.

The move will allow the court to conduct a full evidentiary hearing and will allow attorneys for both sides to conduct additional discovery.

Stender and Jervis have alleged that Lindsey breached her fiduciary duties and was unfit to serve as trustee of the Bishop Estate, a nonprofit charitable trust worth an estimated $10 billion.

Lindsey has said that much of Jervis and Stender's allegations are based on a report by court-appointed fact finder Patrick Yim, which she criticized as unbalanced and based on rumors and innuendo.

She also has said that Stender was waged in a campaign to discredit her.
