Jervis, Stender seek
special administrator
for Bishop Estate

They petition the Circuit Court to
name an administrator to oversee
the estate's response to the
attorney general's probe

Kamehameha Schools/Bishop Estate trustees Gerard Jervis and Oswald Stender today petitioned Circuit Court to appoint a special administrator to oversee the estate's response to the attorney general's investigation of the multi-billion dollar charitable trust.

Jervis and Stender said the trustees face a conflict in overseeing the estate's response to the investigation.

"There is a conflict of interest inherent in a trustee's continued direction of the estate's response to the attorney general's information requests where withholding of information or delay in disclosure could promote the personal interest of that trustee and, thus, interfere with the ability of that trustee to act in the best interest of the estate," the two said.

"The appointment of an administrator ad litem will avoid conflict on the part of any of the current trustees or estate employees and expedite the attorney general's investigation."

The appointed administrator would direct the estate's response to Attorney General Margery Bronster's requests for information, subpoenas and documents. He or she also would direct the estate's legal team.

Trustees would continue to run the trust's day-to-day operations.

An estate spokesman was unavailable for immediate comment.

Bronster today welcomed the petition, saying an administrator ad litem would expedite her investigation, which has run into delays after trustees filed several appeals to subpoenas she issued.

"We strongly believe that it is in the best interest of the Kamehameha students that this investigation be conducted and brought to a closure as soon as possible," said Stender and Jervis. "No one benefits from a protracted, open-ended dog fight."
