Rape case awaits fugitive
A fugitive guilty of sexually assaulting a teenage girl in 2006 was indicted Tuesday on charges of raping another underage girl.
Jon Joseph Rutherford, 21, is wanted by police for failing to comply with the terms of his probation and for the new sex assault charges.
On Jan. 11, Rutherford allegedly raped a girl under the age of 14. He failed to meet with his probation officer on Jan. 31, and his whereabouts are unknown.
He was indicted on two counts of first-degree sexual assault, four counts of third-degree sexual assault and failure to comply with covered offender registration requirements.
In the September 2006 sexual assault, Rutherford met with a 16-year-old girl at the Pink Cadillac nightclub in Waikiki. The two kept in contact through the social networking Web site Myspace.com, according to court records, and later agreed to meet at Pearlridge Center.
There he took her to a shed, where he kissed her and undressed her despite her protests. The girl said she feared for her life, and Rutherford sexually assaulted her.
Later that month, the mother and the girl returned to the Pink Cadillac, where they found Rutherford playing pool. Police were called and Rutherford fled. An all-points bulletin was broadcast, and Rutherford was arrested on Ala Wai Boulevard shortly afterward.
He was charged with first-degree sexual assault, but a judge found him guilty of second-degree sexual assault and carrying a deadly weapon. Prosecutors sought a 10-year prison term, but Circuit Judge Virginia Lea Crandall sentenced him on Dec. 3 to five years' probation and one year in prison.
But because Rutherford received credit for time served and had been jailed for more than a year since his arrest in September 2006, he was released in December.
Prosecutors made a motion Feb. 12 to revoke Rutherford's probation, since he has failed to report and also attempted to contact the girl from the first incident.
CrimeStoppers is asking for the public's help in locating Rutherford. He is known to frequent the Honolulu and Kalihi areas.
He is described as being 5 feet 7 inches tall and weighing about 145 pounds. He has light brown hair, green eyes and a fair complexion.
Bail was set at $250,000.
