Mall owner faces antitrust claim

General Growth Properties Inc., the owner of Ala Moana Center and Victoria Ward Centers, must face an antitrust claim filed by developer Rick Caruso in a lawsuit over a $264.2 million retail project in Los Angeles, an appeal court said.

The ruling Thursday by the California Court of Appeal is the latest concerning Caruso's 15.5-acre retail-and-residential development next to General Growth's Glendale Galleria shopping mall in Glendale, Calif. In September, voters in the Los Angeles suburb approved measures that allowed development of Caruso's project on city-owned land.

The three-judge appellate panel last week rejected General Growth's claim that some of its actions, which formed the basis of Caruso's antitrust allegation, were protected by a California free speech law. Caruso's lawsuit claims that before the election General Growth intimidated tenants that were considering leasing space at Caruso's project.

The court sided with Caruso's arguments that letters written by Chicago-based General Growth were "private solicitations and threats designed to limit competition for tenants and disrupt potential lease agreements."
