Driver indicted in crash
that killed 3 Mililani teens

The driver who allegedly lost control of his car and crashed on Kaukonahua Road above Waialua, killing three of his passengers, has been indicted by an Oahu grand jury.

Brian J.K. Dade allegedly was behind the wheel April 12, 2001, when he lost control, struck a guardrail and was broadsided by another car going in the opposite direction, according to police.

Three fellow Mililani High seniors -- Anthony Delos Reyes, 18, Anthony Alexander, 17, and Jeremy Tolentino, 18 -- were killed. A Mililani couple in another car, Dale and Cecilia Andres, were seriously injured.

The families of Delos Reyes and Alexander later sued Foodland and Dade, saying the store illegally sold liquor to a minor. Tolentino's family also sued Dade and other unidentified parties, alleging negligence.

Dade, who was 18 at the time of the crash, is charged with three counts of second-degree negligent homicide for causing the deaths of Delos Reyes, Alexander and Tolentino. He is also charged with two counts of second-degree negligent injury for causing serious injury to the Andreses. The couple sued for unspecified damages.

Police said at the time that speed and alcohol appeared to be factors in the crash. The charges, however, do not allege alcohol was involved.

Art Ross, the attorney who represented Dade shortly after the crash, said yesterday he had not seen the Thursday indictment and declined comment. Dade could not be reached for comment.

Each of the charges is punishable by five years in prison.
