Man gets jail time
for threats to wife

His defense says that the man is working
to better his marriage

WAILUKU >> A man who allegedly poured gasoline on his wife and then threatened to burn down their house last year has been ordered to serve 30 weekends in jail.

Robert Aldosa, 40, of Wailuku, had pleaded no contest to first-degree attempted criminal property damage, second-degree assault and first-degree terroristic threatening of his wife, as well as abuse of their teenage son.

He also was sentenced to five years' probation last week by 2nd Circuit Judge Joel August.

"I just regret what happen," Aldosa said in court. "My whole family suffered because of what happen. I wish I could turn back time and start all over."

Aldosa's sentencing was delayed from a Sept. 27 hearing after Deputy Prosecutor Jeffrey Keating asked to play a tape of the 911 call made by Aldosa's wife on the day of the incident.

Police officers went to the family's home on Lae Lae Street after Deborah Aldosa called 911 shortly after 6 a.m. on Nov. 19. She told a police dispatcher they had argued and then, "My husband poured gas all over me," and, "My husband raging."

"Clearly, that was the voice of a woman who believed she was going to die," Keating said. "I have never heard anything like that tape."

At sentencing Wednesday, August said he did not think the tape should be played in court. He said he would leave it up to those in charge of any anger management or domestic violence program Aldosa attends to decide whether he should be required to hear the tape.

Keating argued for the full 90-day jail term that the prosecution could seek as part of Aldosa's plea agreement.

Deputy Public Defender Leilani Lujan had asked the judge to limit Aldosa's jail term to 12 weekends over three months.

"The feeling from both ... is that they are working hard on repairing the problems that led to this case, to make their marriage better," Lujan said. "Listening to this tape won't necessarily assist their attempts."
