Judge frees Kihano

The ex-legislator is critically ill

A federal judge has granted a "compassionate release" for critically ill Daniel Kihano, the former State House speaker convicted of wire and mail fraud, money laundering, conspiracy to obstruct justice and witness tampering.

Judge Alan C. Kay yesterday granted U.S. Attorney Steven Alm's motion to reduce Kihano's two-year sentence to time served due to a deteriorating heart condition.

Alm petitioned the court on behalf of the director of the Bureau of Prisons.

Kihano began serving his sentence in August 1998. He suffered a near-fatal heart attack two weeks ago in Lompoc, Calif., and he reportedly has less than one year to live.

"There are times when the ends of justice call for compassion, and this is one of those times," Alm said.

Ben Cassiday, Kihano's attorney, thanked federal officials for showing compassion.

"He's very sick and may die anytime, and his crime was not so serious that he should have to die in prison," Cassiday said. "We're thankful for the ruling."

Kihano can travel with a breathing apparatus, and family will be bringing him home as soon as possible, Cassiday said.
