Appeals court hands Microsoft big victory
WASHINGTON -- Microsoft Corp. is free to offer personal computer makers a version of Windows 95 that integrates its Internet Explorer Web browser, a three-judge federal appeals court ruled in throwing out a December judge's order. The decision could make it harder for the Justice Department and 20 states to win new, more sweeping lawsuits filed in May. Those suits seek to force Microsoft to remove its browser from its new Windows 98 operating system software, or offer a competing browser, such as Netscape Communication Corp.'s Navigator.
While today's ruling has no direct bearing on the new lawsuits filed May 18, it sets guidelines on how U.S. District Judge Thomas Penfield Jackson will be able to rule when that case goes to trial on Sept. 8. Today's ruling from the U.S. Circuit Court of Appeals for the District of Columbia unanimously overturned Judge Jackson's December order in the Windows 95 case that barred Microsoft from integrating its Explorer browser into Windows 95.
