Radio tower case on Kauai
could turn off investors

LIHUE -- The state Board of Land and Natural Resources is mulling a Kauai radio tower case that could expand public influence over land use decisions and send a chilling message to Hawaii investors.

At issue is whether the board legally can reconsider a conservation district use permit it already granted to Stangl Broadcasting for a 250-foot radio tower on Kauai's gateway Haupu Ridge.

The state attorney general's office, directed by the board to review that question last month, has drafted a response but will release the opinion only to board Chairman Mike Wilson. This appears to be the first time the board has been asked to reconsider a permit, as no past opinions were found on the issue, an office spokesman said.

Some Kauai residents, along with Mayor Maryanne Kusaka, say Stangl Broadcasting misled the board and failed to get community comment on the project. They contend the tower will mar the scenic beauty of the ridge, which runs between Lihue and Koloa.

But Stangl attorneys and planners say they won the permit fairly, and no one protested the project at either of two hearings held last year. To them, the idea that residents can miss the public process and then push for reconsideration sends an ominous message to potential investors.

"What it means is your permit can be reopened after substantial investment and you could lose it," said attorney Mike Belles, who represents Stangl on Kauai.

Woman arrested after
in-flight smoking flap

A 40-year-old Quebec woman was arrested yesterday at Honolulu Airport for allegedly assaulting an airline crew member during a flight from New Zealand.

The woman allegedly was smoking aboard the Air New Zealand flight and refused to put out her cigarette.

At one point, she allegedly grabbed the co-pilot by his tie and slapped him in the face, FBI special agent John Pikus said.

The woman was arrested at Honolulu Airport at 10:25 p.m. for interfering with a flight crew.

Recipes give taste
of risk-reducing diet

A selection of risk-reducing recipes will be prepared in a cooking demonstration Thursday at the University of Hawaii Cancer Research Center.

The recipes demonstrated will come from the Nutrition Branch's new cookbook: "5 a Day -- The Hawaii Way: Easy Island Recipes."

New system routes calls
at Volcanoes park

HAWAII VOLCANOES NATIONAL PARK -- A new telephone system was recently installed here.

The upgrade involved the laying of over 8,000 feet of fiber-optic cable and 11,000 feet of copper cable, the park said.

The new phone number for the park is (808) 985-6000.

Direct dialing, voice mail and prerecorded information are part of the new system.

Rodrigues takes post
at Maui District Court

Colin R. Rodrigues will be a new District Court administrator on Maui, effective April 16.

He succeeds the retired L. Louneille Medeiros.

Second Easter Seal
burglary suspect caged

Police yesterday arrested a second suspect in connection with the March 11 theft of a safe from the Easter Seal Society of Hawaii office.

A 22-year-old man, who has no permanent local address, was arrested at 9:35 a.m. after police executed a search warrant at an Alapai Street apartment and recovered evidence related to the Easter Seal office burglary.

Investigators got a break in the case last Thursday with the arrest of a 29-year-old man following a routine traffic stop in Waipahu.

Shane Thomas was charged over the weekend with detention of stolen property and narcotics offenses after police recovered stolen Easter Seal checks in a waist pack from his car.

Thomas is being held in lieu of $20,000 bail.

Three other suspects, who are known to police, are still at large.

In other news:

An Aiea man accused of slamming his girlfriend against a wall, kicking her and threatening her with a pistol Wednesday has been charged with two counts of terroristic threatening. Allen Espineli, 35, of Hapaki Street, is being held on $80,000 bail.

A Honolulu woman who was injured in a snow-boarding accident over the weekend was in guarded condition at Queen's Hospital yesterday.

Megan Murimote, 31, suffered head injuries Saturday while snow-boarding at the summit of Mauna Kea on the Big Island, police said.

A 36-year-old Waipahu man, employed as city bus driver, was arrested yesterday for questioning about an alleged sexual assault reported by an Aiea girl.

The girl, 17, told police she boarded the bus in Pearl City at 7:40 a.m. and notified the driver that she was going to work at the Ilikai Hotel.

She fell asleep on the bus and awoke to find the driver trying to remove her clothes at the Monsarrat Avenue turnaround point, police said.

The girl managed to flee from the bus and called police. The driver was arrested at 11:50 a.m. and booked for third-degree sex assault.

He was later released pending further investigation.
