Housing code governs
neighborhood rentals

QUESTION: Our neighbor on Kukuau Place in Hawaii Kai built a second story on their home and now rents the bottom portion to another family.

Another neighbor converted his garage into a rental and now rents it out to two men.

We do not have ohana zoning in this area so I don't understand how this is possible.

Also, the tenants have at least six cars between them and they park on the street, which makes it impossible for our guests to find a place to park. What can we do about this?

ANSWER: Call 527-6308, the housing code section of the city Building Department, and provide the house numbers so an inspector can check. Additional information is needed to determine if what your neighbors have done is legal or illegal.

For example, if the garage, converted to a rental unit, is attached to the house, the property owner must provide two parking spaces elsewhere on the private property. Those parking spaces must be prepared with an all-weather surface; the area has to be more than just space to park two cars on dirt and grass.

There may or may not be a problem with the "no second kitchen" provisions. Three items are needed to make a kitchen - a sink, a refrigerator, and a stove or cooking equipment. If any of the three is missing, it is not considered a kitchen.
